TERMS OF ENGAGEMENT

Services Rendered

1. The Recruiter agrees to provide college scholarship recruitment services to the Student-Athlete. These services may include but are not limited to:
   – Evaluation of athletic abilities, academic achievements, and career aspirations.
   – Guide on NCAA eligibility requirements, including academic standards and amateurism rules.
   – Identification of suitable college athletic programs and scholarship opportunities.
   – Develop a personalized recruitment strategy tailored to the Student-Athlete’s goals and preferences.
   – Assistance with creating athletic and academic portfolios, including highlight reels and transcripts.
   – Guidance on application procedures and requirements.
   – Create a customized timeline for the college application and recruitment process.
   – Facilitate communication between the Student-Athlete, college coaches, recruiters, and admissions officers.
   – Communication with college coaches and recruiters on behalf of the Student-Athlete.
   – Negotiate scholarship offers and financial aid packages on behalf of the Student-Athlete.
   – Monitor and track the progress of the recruitment process, including following up on applications and inquiries.
   – Offer ongoing support and advice throughout the recruitment process, including assistance with decision-making and commitment to a college program.
   – Provide guidance on the National Letter of Intent (NLI) process, including understanding the terms and conditions of the NLI agreement, and advising on the implications of signing the NLI.
   – Assisting with the preparation and submission of the NLI, ensuring compliance with all required documentation and deadlines.
   – Offer advice on the visa application process for international student-athletes.
   – Offer ongoing and regular support while attending the college or university.
2. Disclaimer: The Student-Athlete and/or Guardian acknowledges that while the Recruiter will make every effort to assist in securing a college scholarship, no specific results or outcomes can be guaranteed. The Recruiter cannot guarantee acceptance into any college program or the awarding of any scholarship. Lead Scholarships maintains relationships with coaches and schools, though Lead Scholarships is not affiliated with any college, university, association, or conference.
3. Duties and obligations to the Recruiter. The Recruiter agrees to:
   – Provide honest and accurate assessments of the Student-Athlete’s abilities.
   – Act in the best interest of the Student-Athlete at all times, upholding a fiduciary duty to prioritize the Student-Athlete’s interests with good faith and integrity.
   – Maintain confidentiality regarding the Student-Athlete’s personal information.
   – Provide timely updates on the progress of the recruitment process.
4. Duties and obligations of the Student-Athlete. The Student-Athlete agrees to:
   – Provide truthful and complete information to the Recruiter.
   – Follow the guidance and recommendations provided by the Recruiter.
   – Fulfill all academic and athletic requirements for college applications.
   – Notify the Recruiter of any changes in academic or athletic status.
   – Maintain exclusivity in their engagement with the Recruiter throughout the duration of the recruitment process. This means the Student-Athlete will not engage with other recruitment services or pursue college scholarship opportunities independently while under agreement with the Recruiter.
5. Jurisdiction of New Zealand. These Terms shall be governed by and construed in accordance with the laws of New Zealand. Any dispute arising out of or in connection with these Terms shall be subject to the jurisdiction of the courts of New Zealand.
6. Privacy. The Recruiter agrees to handle all personal information provided by the Student-Athlete in accordance with applicable privacy laws. Personal information will only be used for the purpose of providing recruitment services and will not be disclosed to third parties without the Student-Athlete’s consent. The Student-Athlete’s personal information may include but is not limited to their name, contact details, academic records, athletic achievements, and any other relevant information necessary for the recruitment process. Furthermore, the Student-Athlete must keep any contacts they acquire through the recruitment process confidential and not disseminate them without the consent of the Recruiter or the respective individuals. This includes contact information for college coaches, recruiters, admissions officers, and any other parties involved in the recruitment process.
7. Duration. This agreement shall remain in effect until the Student-Athlete accepts a scholarship offering or if both parties mutually agree in writing to terminate it.
8. Waiver. The Student-Athlete and Guardian understand that participation in college athletics may involve inherent risks, including but not limited to physical injury, illness, or other health-related issues. The Student-Athlete and Guardian hereby release, waive, and discharge the Recruiter from any and all liability, claims, or causes of action whatsoever arising out of or related to any loss, damage, or injury that may be sustained by the Student-Athlete.
